- The tenancy ended on 20 June 2025 pursuant to the landlord’s notice of termination. The landlord provided rent and water records which prove the amount owing at the end of the tenancy. Cleaning and Rubbish
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.

- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
- Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent.

- There were holes in the walls of the premises. A quotation for $402.50 has been obtained. This is less than the insurance excess. The front gate had been bitten repeatedly by the tenant’s dog and stopped working. Insurers paid for replacement ($7,116.20) less the insurance excess of $1,150.00 which Is awarded. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. Filing Fee
- The landlord’s application has succeeded. I award the filing fee ($28.00).
- The tenant was ordered to pay the filing fee of $27.00 for a previous Tribunal application (No. 5131749) pursuant to a mediated order dated 25 February 2025. The landlord requested that this fee be included in this order.
