Order
- The tenancy of Jamie Louise Clarke and Gregory Dwayne Lyden at 85 Glengarry Road, Glen Eden, Auckland 0602 is terminated, and possession is granted to Beta Property Investment Limited, immediately.
- Jamie Louise Clarke and Gregory Dwayne Lyden must pay Beta Property Investment Limited $11,418.71 immediately, calculated as shown in the table below.
- The Bond Centre is to pay the bond of $2,600.00 (3308205-002) to Beta Property Investment Limited immediately.
Reasons
- The landlord attended the hearing on 27 January 2026. The tenant did not.
- The notice of hearing and application were sent to the tenant’s email address for service recorded in the variation to the tenancy agreement.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- As the applicant, the landlord must prove their claim to the civil law standard of proof, on the balance of probabilities.
Should the tenancy be terminated?
- The landlord filed their application on 16 September 2025. Rent was $3,435.70 (37 days) in arrears on this date. Because rent was at least 21 days in arrears on the date the application was filed, the tenancy is terminated. 1
How much does the tenant owe in rent arrears?
- The landlord submitted a rent summary, which I accept as accurate. It proves the tenant owes $13,990.71 in arrears up to 27 January 2026.
- The landlord filed their application promptly when rent arrears were at a reasonable level. Due to prior failed attempts at mediation, it has taken longer than usual for the matter to be scheduled for hearing. This has meant rent arrears have increased over this time. This is not the fault of the landlord. I am satisfied the landlord has acted reasonably to mitigate their loss by filing their application promptly.
- The landlord’s claim for rent arrears is granted for $13,990.71. 1 Residential Tenancies Act 1986, section 55(1)(a). Filing fee
- Because Beta Property Investment Limited has wholly succeeded with the claim I must reimburse the filing fee.
