Claim types — money lines allowed on this order
Order
- Mandy - Jade Arnold must pay Lynette Marie Sefton and Brian William Thomas Sefton $4,949.00 immediately, calculated as shown in table below:
- This order incorporates the Tribunal order application filing fee made on 4 December 2024 under application 5021173.
- The Bond Centre is to pay the bond of $500.00 (BN-00002118) to Lynette Marie Sefton and Brian William Thomas Sefton immediately.
Reasons
- The landlord attended the hearing, conducted via teleconference. The call to the tenant went unanswered I was satisfied adequate service had completed and I continued with the hearing.
- The landlord sought rent arrears, the bond and the application filing fee.
- On 4 December 2024 the Tribunal made an order relating to this tenancy, for conditional termination and rent arrears. The tenancy continued after the key term of debt payment was missed as the parties agreed an alternative pathway. The landlords have sought enforcement of that order but that has stalled given the disparity between the terms of the order and the final rent arrears. The previous monetary order is incorporated into this order for enforcement purposes. The rent arrears have reduced since and the ordered amount here is inclusive of any arrears at the date of the prior order. The debt in order 5021173 is no longer enforceable. Rent arrears
- The landlord produced a final rent summary that confirms rent owing of $5,394.00 to 4 June 2025, being the date they accepted the tenant’s surrender of the tenancy. Filing fee
- Because Lynette Marie Sefton, Brian William Thomas Sefton has wholly succeeded with the claim I must reimburse the filing fee.
