Order
- The Bond Centre is to pay the bond of $196.00 (5804123-003) to Kāinga Ora– Homes and Communities immediately.
- Khalina Lisa Pook must pay Kāinga Ora–Homes and Communities $5,008.41 immediately :
Reasons
- Only the landlord attended the hearing which was held by video conference.
- I am satisfied that the tenant has been served with the landlord’s application in accordance with the provisions of the Residential Tenancies Act 1986 and so the hearing proceeded in the tenant’s absence.
- The landlord has applied for compensation and refund of the bond following the end of the tenancy. Rent credit
- This was a long term tenancy that began 21 May 2014 and ended on 21 July 2025. The landlord advised that there is a rent credit owing to the tenant in the amount of $360.00 and so this amount has been included in the table above and has been deducted from the total amount owing by the tenant.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord says that the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
- The landlord claims the following amounts from the tenant: a. Glass slashing and mowing - $522.00 b. Rubbish removal interior - $1,070.93 c. Rubbish removal exterior - $3369.09 d. Cleaning - $602.39
- The landlord produced photos showing that the property was left very dirty and the grass was overgrown. There was rubbish left scattered throughout, and there were a huge amount of items left in the garden including the hulls of two boats, a kayak, a spa pool, tyres and various miscellaneous items. The tenant consented to the disposal of these items.
- I am satisfied that the amounts claimed are reasonable based on the work required.
- The landlord’s claims are proved.
- The landlord waived reimbursement of the filing fee.
