- Zaeline Blu Robson must pay current rent and the debt as follows: a. By 258 weekly payments of $188.00, being $162.00 for current rent and $26.00 for the debt. b. A final payment of $171.42, being $162.00 for current rent and $9.42 for the debt. c. Payments will be every Thursday, with the first payment on 05/02/2026 and continuing until 16/01/2031.

- If the tenant fails to pay current rent and rent arrears within 5 working days of the due dates: a. Reasons
- The hearing was scheduled to be conducted by videoconference.
- Due to technical issues, Ms Gray appeared for the landlord by teleconference.
- Ms Robson, the tenant, did not attend the hearing. She did not inform the Registry of the reasons for her non-attendance. I attempted to contact Ms Robson at her most recent telephone number, ending in 2143, without success
- The hearing therefore proceeded in her absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- Ms Gray informed me that the parties had entered into an arrangement to pay off the debts. The arrangement commenced two weeks prior. Ms Robson had been paying her current rent and rental arrears in accordance with that arrangement. This is the same arrangement Ms Gray invited me to consider for a conditional order.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Filing fee
- Because Kāinga Ora–Homes And Communities has wholly succeeded with the claim I must reimburse the filing fee.
