The landlord attended the hearing by telephone.
Jason Smart attended the hearing by telephone.
Alesha Smart was telephoned on the two numbers provided but did not answer either call.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).
The landlord provided rent records which prove the amount owing at the end of the tenancy.
Jason Smart is the guarantor of the tenancy agreement. It records: “I agree to take responsibility for anything the tenant is liable for during the tenancy including extension if any.”
The tenancy began as a fixed term tenancy which ended on 10 August 2025. The tenancy then became a periodic tenancy.
Jason acknowledges that he guaranteed the tenancy of Alesha. He explained that he vacated the property in June 2025 and was not aware that there was a problem with payment of the rent until November 2025 when he received an email regarding mediation.
I have considered Jason’s liability as guarantor. There is no requirement that he be notified as guarantor of any default prior to the landlord making an application to the Tribunal. It is for a guarantor to keep themselves informed as to whether the tenant is meeting her obligations. The landlord is entitled to rely on the guarantee which was an essential term of the landlord granting the tenancy.
As discussed at the hearing, a guarantor has no ability to release himself from a guarantee without the consent of the landlord. At the hearing the landlord did not consent to Jason’s release. The terms of the guarantee continued after the expiry of the fixed term.
I therefore confirm that the guarantor is jointly and severally liable with the tenant under the guarantee to pay the landlord the sum ordered. See section 77(2)(ka) RTA.
Because Wongeoon Vast Limited has wholly succeeded with the claim I must reimburse the filing fee. .
