- On 22 August 2025 the tenant advised that she was vacating the tenancy. She is required to pay rent to 12 September 2025 which takes into account the 21 day notice period that she ought to have given.
- I accept that the rent record shows that as at 12 September 2025 the tenant owed $1,212.85 in rent.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The photographs show that the tenant left a significant amount of rubbish behind, both inside and outside the house.
- The photographs also show that the house was not left in a reasonably clean condition.
