Reasons
- Both parties attended the hearing. The hearing was scheduled as a video conference but Ms Green and Mr Blakeborough attended by telephone. Mr Singh attended for the landlord.
- The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy is $6,550.00.
- The parties signed a fixed-term tenancy agreement to begin on 22 August 2025 and end on 21 August 2026.
- Ms Green said that she then lost her job, could no longer afford the rent, gave notice to end the tenancy and moved out. Ms Green said she gave notice to end the tenancy in November 2025 and she received a return email from the landlord regarding charges that may be charged. It appears an end of tenancy date was not agreed on. Ms Green said that she still has some belongings at the property.
- The parties agreed that 9 February 2026 would be the last day of the tenancy. Ms Green said she would be able to remove the last of her belongings from the property before that date. Mr Singh said that no rent would be charged beyond that date and the landlord was not claiming any expenses relating to reletting the property.
- The landlord may make another claim regarding end of tenancy expenses. This may include a charge relating to Mr Blakeborough’s name being removed from the tenancy agreement in November 2025, which was raised today by Ms Green. Mr Singh could not access information about this claim.
- Because Tbt Property Management Limited As The Agent For Ttb 13 Ltd has wholly succeeded with the claim I must reimburse the filing fee.
