- The rent credit of $226.85 is to be refunded to the landlord to offset the debt owed by the tenant to the landlord.
Reasons
- The landlord attended the hearing, but the tenant did not attend. I rang the tenant on two different mobile numbers, but the calls went unanswered. The tenant has not communicated with the Tribunal seeking an adjournment. The tenant has been served with a notice of hearing. I am proceeding with the hearing in the absence of the tenant.
- The landlord has applied for compensation following the end of the tenancy. Rent credit:
- The tenancy ended on 30 September 2025. The landlord provided rent records which prove that there was a rent credit of $226.85 at the end of the tenancy. The $226.85 will be used to offset some of the vacated costs that the tenant owes to the landlord.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
- The landlord has provided the pre let inspection report and photos and the exit report and photos. The exit inspection report and photos show that the tenant did not leave the place reasonably clean and tidy and left rubbish on the property.
- The landlord also provided invoices to prove the cost of the cleaning and rubbish removal. There were costs of $82.11 for removing rubbish on the inside of the property and costs of $308.50 for the removal of rubbish from the exterior of the property. The cleaning costs were $268.54 for the house and an additional $104.26 for the kitchen cupboards.
- I am satisfied that the landlord has proven their claim for the cost of the cleaning and rubbish removal.
- The amounts ordered are proved.
