Reasons
- This application was scheduled to be heard by teleconference. I rang the numbers provided for both tenants. The phone call to Ms Sisi Lealaiauloto did not connect and both calls I made to the number provided for Ms Moana Tiatia went to voicemail. The hearing proceeded in their absence.
- The landlord has applied for termination of the tenancy, rent arrears, outstanding water rates, reimbursement of the filing fee and payment of the bond.
- Rent was at least 21 days at today’s date and so the tenancy is terminated. See section 55 Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing as at today’s date - $4,225.71. This amount includes the last payment of rent of $695.00 on 17 December 2025.
- I also accept that there is $395.88 owing in water rates.
- Further, I am ordering the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful with the claim against them. C ter Haar 13 January 2026
