- The landlord attended the hearing by video call.
- The tenant did not connect to the video hearing. The was telephoned on the phone number provided but the phone call went unanswered. I am satisfied the tenant was properly served with notice of the hearing. The hearing proceeded in her absence.
- The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee. Termination
- The Tribunal shall make an order terminating the tenancy if satisfied that the rent was, at the date the application was filed, at least 21 days in arrears. 1 Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated.
How much is owed for rent?
- The tenant must pay the rent as and when it is due and payable under the tenancy agreement. 2 The landlord provided rent records which prove the amount owing as at termination date and I have made an order accordingly. Other claims
- The landlord amended the claim before the hearing to include compensation claims for unlocking the premises for the tenant and power accounts. The landlord had not provided the invoices in support of the claim and these claims were not included in original application or the hearing notice. I indicated these claims, including a claim for the bond will need to be filed as a fresh application so that the claims can be assessed by Tenancy Services and so the tenant has notice of the claims. The landlord should submit invoices in support of a claim for compensation and outgoings. Filing fee
