Order
- Home In Place (New Zealand) Limited must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.
- The landlord may dispose of the other goods left at the premises as the landlord sees fit after 2 working days, if the tenant has not collected all her property.
- Alisa Grant owes Home In Place (New Zealand) Limited the sum of $28.00 from the bond for reimbursement of the filing fee, as set out below:
- The remaining bond is to be left at the bond centre as there are further applications to be made by the landlord relating to vacated costs.
Reasons
- The landlord attended the hearing, the tenant did not attend. The tenant was served with the notice of hearing and has not communicated with the Tribunal seeking an adjournment. I am proceeding with the hearing in her absence.
- The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.
- The landlord: a. is unable to contact the tenant. b. is unable to agree with the tenant on a period for the tenant to collect the goods. c. agreed on a period for the tenant was to collect the goods, but the tenant failed to collect the goods within that time.
- It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
- The tenancy was terminated by order of the Tribunal. Since termination, the tenant has failed to collect her property from the premises, despite reasonable efforts by the landlord to work with her to arrange collection.
- Under section 62 of the Residential Tenancies Act 1986, when tenant leaves goods at the premises after the tenancy has ended, the landlord must make reasonable efforts to contact the tenant and provide a reasonable opportunity for the goods to be collected. If the goods are not collected within a reasonable time, the Tribunal may authorise the landlord to dispose of the goods.
- Accordingly, the tenant is given 2 working days from the date of this order to remove her property from the premises. If the property is not removed within that time, the landlord is authorised to dispose of the goods in accordance with section 62 of the Residential Tenancies Act 1986.
- Because Home In Place (New Zealand) Limited has wholly succeeded with the claim I must reimburse the filing fee.
- The landlord will incur costs associated with the removal of the tenant’s property from the house. In addition, there was other costs associated with the termination of the tenancy, such as cleaning and damages. The Bond Centre is to keep the remaining bond, after paying the landlord for reimbursement of the filing fee, at the bond centre.
