The landlord attended the hearing on 16 March 2026. The tenant did not.
The notice of hearing and application were sent to the tenant at the email address recorded as an address for service on the tenancy agreement. I am satisfied the tenant has been given appropriate notice of the hearing and failed to attend.
The landlord seeks compensation, a refund of the bond and reimbursement of the application fee, following the end of the tenancy.
As the applicant, the landlord must prove their claim to the civil law standard of proof on the balance of probabilities. LANDLORD’S CLAIM
The premises are a unit in an apartment complex. There is a Body Corporate, which creates rules that all owners and occupants must comply with. These are known as the “Body Corporate Rules.”
The tenancy agreement contains a provision about the Body Corporate Rules. It states: As part of the Unit Titles Act, all residents within the building need to be provided with a copy of the Body Corporate rules. These rules form part of the conditions of this tenancy and all occupants are required to abide by these rules as well as the Residential Tenancies Act...
The tenant has initialled this part of the tenancy agreement to confirm that they have received a copy of the Body Corporate Rules.
The landlord claims the tenant breached the Body Corporate Rules during the tenancy, which resulted in the landlord receiving an invoice for $1,063.75 from the Body Corporate. The landlord submitted a copy of the invoice. It records breaches of the Rules such as, anti-social behaviour by going through the building’s rubbish bins and leaving a mess, vaping in common areas and tail gating.
I accept the landlord’s evidence, which is uncontested and corroborated by the invoice and detailed notes about each breach.
On the balance of probabilities, I find the tenant breached the tenancy agreement by failing to comply with the Body Corporate Rules during the tenancy. The landlord has suffered a loss of $1,063.75 as a result.
For these reasons, the landlord’s claim for compensation of $1,063.75 is granted.
Because the landlord has wholly succeeded with the claim, I order the tenant to reimburse the landlord $28.00 for the filing fee. For the same reason, I grant the landlord’s request for name suppression.
