- The landlord attended the hearing. The tenants did not attend the hearing by video, or phone. They were called on both numbers in the application but none of the calls were answered. I am satisfied that they were notified of today’s hearing and have proceeded in their absence.
- The landlord has applied for termination of the tenancy, rent arrears, water rates and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records and water rates records which prove the amount owing at the end of the tenancy.
- Because The Worx Property Management Limited As Agent For Ankita Diwan has wholly succeeded with the claim I must reimburse the filing fee.
