Payment must continue to be made by instalments of $10 per week every Tuesday with the next payment due on Tuesday 3 March 2026. If any payment is not made within two working days of the due date, the full amount then owing will become due and payable and enforceable as an order of the District Court.

Reasons

Only the landlord’s representative attended the hearing.
The landlord has applied for compensation following the end of the tenancy on 15 October 2025.
At the end of the tenancy the tenant must, among other things, remove all rubbish and leave all chattels provided for their benefit.
The tenant did not remove all rubbish.
The rangehood filter was missing at the end of the tenancy.
The tenant must not carelessly or intentionally damage the premises.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent).
Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent).
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.

There was extensive damage to the premises during the tenancy. Kitchen cabinet doors were missing, carpet was damaged beyond cleaning or repair, door hinges and latches were missing, and walls were extensively damaged by holes put in them.

The landlord is not insured for the damage and no single incident of damage exceeds the weekly market rent for the premises.
The landlord has depreciated the claims for the damaged carpet by 62.5% based on the expected life of the carpet and its age. I consider that to be a reasonable assessment of betterment.
The amounts ordered were proved by the production of photographs, the landlord’s standard charges and the Tribunal’s assessment of the reasonable cost of the relevant work and materials.
The landlord withdrew claims for cleaning and a missing wardrobe door and reduced the claim for rubbish removal.
