Reasons

The hearing was conducted via video conference.

Mr Peters, the property manager, attended the hearing on behalf of the landlord.

Mr. Reader, the tenant, did not attend the hearing. He did not call in to join the hearing, nor did he file any application seeking an adjournment or provide any reasons for his absence.

I am satisfied that Mr. Reader was served with the Notice of Hearing. The hearing therefore proceeded in his absence.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).

For completeness, I also record what Mr Peters told me about the tenancy since the conditional termination order was issued on 07 May 2025.

A conditional termination order was made by the Tribunal on 7 May 2025. That order provided that if Mr Reader failed to pay the current rent and rent arrears within two working days of the due date, the tenancy would terminate immediately, and Mr Peters would have immediate possession of the premises. The order also allowed the landlord to enforce possession within 90 days from the date of the first breach.

Mr Peters confirmed at the hearing that Mr Reader did not comply with the conditional termination order. Mr Reader failed to keep up with the required payments. Although Mr Peters had the right to enforce the possession order within 90 days from the first breach under section 64(4)(b) of the RTA, no steps were taken to do so during that period. Consequently, Mr Peters has applied to the Tribunal again for clarification and orders relating to the rent arrears, bond refund, and possession of the property.

Mr Peters advised that he attended the property on 13 December 2025, which was the final date of the tenancy. There was no response at the door, and upon a further inspection this morning, he found that Mr Reader had vacated the premises but left most of his belongings behind. Mr Reader has collected only a few items.

In relation to the visit this morning before the hearing, Mr Peters said that the property “wasn’t in a good condition”. He also said he would file a further application after completing the final inspection.

The landlord provided rent records which prove the amount owing at the end of the tenancy. Filing fee

Because Js Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
