Reasons
- The hearing was conducted by telephone. The landlord, Mr Jaura, attended and was heard. The tenant, Mr Wharakura, did not attend.
- I attempted to contact Mr Wharakura using the contact numbers provided. Calls to the number ending 5607 went to voicemail, and I was unable to leave a message. A further attempt to contact him on the number ending 5605 was unsuccessful, as the number did not appear to be active. Accordingly, I proceeded in the absence of Mr Wharakura.
- Mr Jaura advised that Mr Wharakura is currently maintaining payment of the ongoing rent, but has accumulated rent arrears in the sum of $4,108.76. He stated that despite repeated reminders and requests, those arrears remain unpaid. Mr Jaura explained that Mr Wharakura has directed him to contact Work and Income New Zealand (WINZ), for his unpaid rent because he has no available funds.
- Mr Jaura further advised that he has been in communication with Mr Wharakura’s case manager at WINZ for several months. He was informed that all payments due to the tenant have already been made to him, and that any outstanding rent would need to be paid by Mr Wharakura from those funds. Despite this, the arrears remain unpaid, and Mr Jaura considers himself unable to resolve the matter directly with either Mr Wharakura or WINZ.
- In relation to Mr Wharakura’s circumstances, Mr Jaura noted that the tenancy originally involved both Mr Wharakura and his mother, who has since passed away. He expressed some sympathy for Mr Wharakura’s situation but described him as difficult to communicate with and unresponsive regarding the arrears.
- Mr Jaura confirmed that he does not seek termination of the tenancy. Instead, he seeks an order requiring Mr Wharakura to pay the outstanding rent arrears of $4,108.76, with the intention that such an order may assist in facilitating deductions through WINZ to repay the debt.
- The landlord has applied for rent arrears and has provided rent records that prove the amount owing. An order is made accordingly. Filing fee
