Reasons
- The applicant attended the hearing by video link. The respondent did not attend or answer the phone.
- The applicant made the application seeking termination of the tenancy and payment of rent and water rates arrears and the remedy of breaches related to damage at the property.
- The applicant stated that the tenant has now paid the rental arrears and that the tenancy is due to end on 13 March pursuant to a 90-day notice.
- In these circumstances, the applicant no longer seeks immediate termination and is prepared to allow the tenant to remain in occupation until the expiry of the notice period, at which time the tenant is expected to vacate.
- They are still seeking payment of the water rates arrears and have provided records showing the mount owing. I am satisfied these records are correct.
- The applicant has provided photographs showing damage to the walls and the installation of fixtures they tell me was without the landlord’s consent. The landlord submits that these matters constitute breaches of section 40 of the Residential Tenancies Act 1986.
- Section 40 requires that, at the conclusion of the tenancy, the tenant must leave the premises in a reasonably clean and tidy condition and remove all rubbish. Section 40(2)(a) also prohibits a tenant from intentionally or carelessly damaging the premises.
- If, at the end of the tenancy, the premises are not left in the required condition or there is damage attributable to the tenant, the landlord is entitled to remedy those issues and seek recovery of the reasonable costs from the tenant. The applicant has indicated that this is the course they intend to pursue.
- Because Ravenstone Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
