Claim types — money lines allowed on this order
Order
- Raymond Cullen must pay Fair Rentals Limited As Agent For Rajesh Raval $5,607.27 immediately, calculated as shown in the table below:
Reasons
- Mr Singh, representing the landlord, attended the video conference hearing. The tenant did not join the hearing conference as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenant was served, the hearing proceeded in his absence.
- The landlord has applied for rent arrears, outgoings, compensation, refund of the bond and reimbursement of the filing fee.
- At the start of the hearing, the landlord clarified there was no compensation claim as it was only the filing fee reimbursement sought in that regard. Further, the landlord withdrew the claim for refund of the bond, as that has already been ordered, as per below.
- The landlord made an earlier application 5183239, where a Tribunal order was made dated 28 April 2025, which ordered termination of the tenancy, rent arrears of $6,900.00 up to 28 April 2025, reimbursement of that filing fee and refund of the full bond of $2,080.00 to the landlord.
- Whilst the Tribunal ordered the tenancy be terminated as at 28 April 2025, the landlord said the tenancy actually ended on 11 November 2025.
What does the tenant owe for rent and water bills?
- The landlord has provided rent records which prove the amount owing to 11 November 2025, which show rent arrears of $11,900.00 to this date. However, due to the earlier Tribunal order dated 28 April 2025 in application 5183239, I deduct the $6,900.00 ordered for rent arrears up to 28 April 2025 in that order from the $11,900.00 rent arrears owing to 11 November 2025, which comes to $5,000.00 owing by the tenant in rent arrears from 29 April 2025 to 11 November 2025.
- The landlord provided water invoices and a water ledger, which showed the tenant owes $579.27 in water bills up to the end of the tenancy, which I award to the landlord. Filing fee
- Because Fair Rentals Limited As Agent For Rajesh Raval has been successful with the claim I must reimburse the filing fee.
