Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- Ms Duckworth explained that she, the tenant Ms Biddle, and the property owner had discussed the rent arrears prior to the hearing. Ms Biddle had previously attended mediation and obtained hardship funds from her KiwiSaver account, which were expected to be paid in early December 2024. That payment did not occur. Ms Duckworth stated that Ms Biddle had since lost her job and was now in financial difficulty.
- Ms Duckworth advised that Ms Biddle had an appointment with Work and Income (WINZ) scheduled for the following morning to seek payment of all rent and water arrears. The property owner had indicated that if payment was received following that appointment, he was prepared to allow the tenancy to continue. However, if payment was not received, the landlord sought termination.
- Ms Duckworth confirmed that the total rent arrears as of today (14 January 2026) were $2,120, and the water arrears were $383.59, for a total of $2,503.59. She requested that, if funds were not received by Friday, 16 January 2026, the tenancy be terminated. If payment was made, she asked that the tenancy continue and that future rent be redirected directly from WINZ to the property management company. She confirmed that rent is due weekly, with the rent week running from Friday to Thursday, and that payments are typically received on Wednesdays.
- Ms Biddle agreed with the arrears amounts stated by Ms Duckworth. She confirmed that she was aware of the landlord’s position and that she would be attending the WINZ appointment in an effort to have the arrears paid. She also agreed to the proposal for rent redirection from WINZ, explaining that her benefit is paid on Wednesday nights, and the redirection would ensure rent is paid automatically before she receives her personal funds
- Ms Biddle further stated that she wished to comply with all legal obligations and ensure the matter was properly resolved. She expressed that she was attending the hearing to confirm her understanding of the process and the landlord’s position.
- Accordingly, I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Filing fee
- Because Inspire Real Estate Limited As Agent For Hayden Low has wholly succeeded with the claim I must reimburse the filing fee.
