Order
- The tenancy of Sheridan Gallon-Puhara and Tyson Simeon at 25 Harbour Road, Ohope, Ohope 3121 is terminated, and possession is granted to Glen Anne Lindsay and Sean Donohue, immediately.
- The Bond Centre is to pay the bond of $3,000.00 (BN-00018938) to Glen Anne Lindsay and Sean Donohue immediately.
- Sheridan Gallon-Puhara and Tyson Simeon must pay Glen Anne Lindsay and Sean Donohue $6,042.29 immediately, calculated as shown in the table below:
Reasons
- The landlord attended the hearing held on 12 February 2026 by video. The tenant did not attend the hearing. An attempt was made to join the tenant to the hearing by telephone, but the call went to voicemail.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 6 December 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.
- The landlord applied for expediated abandonment but did not provide the Tribunal with photographs showing that the premises had been abandoned. That evidence is now before the Tribunal.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The tenancy was for a fixed term due to end on 24 January 2026. The Residential Tenancies Act 1986 1 provides that following abandonment, a tenant is liable, in the case of a fixed term tenancy, for rent arrears to the date of expiry or the date of commencement of a new tenancy. As the landlords have been waiting for this hearing they have been unable to secure new tenants for the premises.
- The landlord provided rent records which prove the amount owing to the end of the fixed term tenancy.
- Because Glen Anne Lindsay, Sean Donohue has wholly succeeded with the claim I must reimburse the filing fee. 11 Section 61(3)(b) Residential Tenancies Act 1986
