Order
- Lakisha Shontay Batters must pay Kāinga Ora–Homes And Communities $3,511.81 immediately, calculated as shown in table below.
Reasons
- Ms Davis attended the hearing for the landlord. The tenant was phoned on the number provided but there was no response to the calls.
- The landlord has applied compensation following the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- The tenant did not leave the premises reasonably clean and did not remove all rubbish as required by section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986 (the Act).
- The amounts ordered are proved.
Is the tenant responsible for the damage to the premises?
- The landlord has established that the premises were damaged during the tenancy, in particular: the entry door was removed; the toilet roll holder was broken; and and the carpets in the lounge were damaged by stains which could not be removed by cleaning. The damage is beyond fair wear and tear and the tenant had not disproved liability for it: sections 40(2)(a), 41 and 49B of the Act.
- The amounts ordered are proved. Betterment and depreciation have been taken into account for the cost to replace the lounge carpets. The carpets were approximately 6 years old and carpets are expected to last approximately 10 years before requiring replacement.
