Order
- Therese Helen Johnson must pay Thornton Lodge Cambridge Limited $170.14 immediately, calculated as shown in table below.
- The Bond Centre is to pay the bond of $1,040.00 (BN-10001214) to Thornton Lodge Cambridge Limited immediately.
Reasons
- The landlord attended the hearing on 19 January 2026. The tenant did not.
- The landlord’s written application sought termination, rent arrears and refund of the bond. By the date of the hearing, the tenancy had ended. Therefore, the landlord only sought rent arrears and refund of the bond.
- The landlord requested to amend their claim to also include compensation for cleaning and repairs. The notice of hearing and application sent to the tenant did not include these things. Therefore, I declined to allow the landlord to seek them at the hearing. The tenant has not received proper notice that the hearing would involve such claims. The landlord may file a fresh application for these matters if they wish.
- As the applicant, the landlord must prove their claim to the civil law standard of proof, on the balance of probabilities.
How much does the tenant owe in rent arrears?
- The landlord gave evidence the tenancy ended on 21 December 2025. I accept the landlord’s evidence.
- The landlord submitted a rent summary, which records rent arrears as being $1,182.14 up to 21 December 2025.
- I accept the landlord’s rent summary as accurate and grant their claim for rent arrears for $1,182.14. Filing fee
- Because Thornton Lodge Cambridge Limited has wholly succeeded with the claim I must reimburse the filing fee.
