Should the tenancy be terminated?

The landlord filed their application on 15 December 2025. Rent arrears were $2,110.00 (35 days) on this date. Because rent was at least 21 days in arrears on the date the application was filed, the tenancy is terminated. 1
Two lump sums of $1,680.00 were paid towards the arrears on 30 January 2026 and 2 February 2026. One of these payments was the bond and another was a lump sum payment from Work and Income New Zealand (WINZ). The arrears have reduced since the date the landlord filed their application however, this is the result of two, one off lump sum payments that are unlikely to occur again. The tenant has paid rent on time for the last three weeks, but no further amounts towards the arrears have been paid. For these reasons, I am not satisfied the tenant will be able to clear the arrears within a timeframe specified by the Tribunal. I am also not convinced the tenant will not commit another relevant breach in the future. This is not an appropriate case to make a conditional termination order.
