Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed on the 16 December 2025. The landlord has also issued multiple breach letters to the tenants for rent arrears which remain unremedied.
- The tenancy is terminated. See section 55(1)(a) and s56(1) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The tenant today sought a conditional termination order rather than a final termination order because he says he can get the money from his Kiwisaver account and needs a Tribunal order to access those funds.
- I decline a conditional termination order because the tenants have not paid any rent since October, I am therefore not satisfied that the are unlikely to breach again. I consider that a tenant who was committed to paying rent, despite financial difficulties, would have made some payment towards rent and rent arrears in that time. The tenants had also made various promises to the landlord of the money being paid which have not eventuated.
- The landlord is successful and is entitled to the filing fee.
