Order
- Lipene Mene, Janet Mege and Ano Peteru must pay Southern Suburbs Realty Limited As Agent For Jaybay Properties Ltd $1,640.72 immediately, calculated as shown in table below:
- The Bond Centre is to pay the bond of $1,126.91 (5724431-005) to Southern Suburbs Realty Limited As Agent For Jaybay Properties Ltd immediately.
Reasons
- Only the landlord attended today’s hearing. The tenants did not attend either by video or phone.
- The landlord has applied for the balance of water rates owing at the end of the tenancy.
- The tenants were required to pay for water consumption in their tenancy agreement.
- They paid the invoices regularly up until June 2024, when there was a leak at the property. They did not start paying for water again until October 2025. The tenants were not charged the full amount during the period that there was a leak at the property. The landlord adjusted their invoices so that the tenant was only required to pay the usual amount that they paid for water consumption. The tenants paid that amount.
- The landlord provided me with a ledger of the water rates and the Watercare invoices. That shows me that the tenants have only been invoiced for the water that they used.
- The landlord tells me that the tenants were invoiced monthly and were given many opportunities to start paying towards water. The landlord says that the tenants started paying again in October last year and paid what they could towards the water arrears.
- I am satisfied that the amount claimed is owed by the tenants.
- Because Southern Suburbs Realty Limited As Agent For Jaybay Properties Ltd has substantially succeeded with the claim I have reimbursed the filing fee.
