Both parties attended the hearing which was held by video conference. Adam Frost advised that he had the authority to represent Darcie Frost at the hearing.

The landlord has applied for compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy.

Are the tenants responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenants must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent). See section 49B(3)(a) RTA.

The landlord claims the cost of repair to ripped wallpaper in the dining room ($402.50) and the insurance excess payable for the cost of replacing ripped wallpaper in the entrance stairway ($1,000.00).

With regard to the dining room, the pre-entry inspection report done at the beginning of the tenancy shows that the wallpaper in the dining room was already lifting. Once wallpaper is lifting, I am satisfied that fair wear and tear ensures that it lifts more and comes away from the wall.

Given that I accept that the ripped wallpaper here is fair wear and tear I am dismissing this part of the landlord’s claim.

When making awards of damages, the Tribunal must take depreciation into account. Depreciation tables put the life expectancy of wallpaper at between 5 and 12 years.

The entrance stairway is a high traffic area and so the expected life of wallpaper in that area would be at the lower end of the scale.

The landlord advised me that the wallpaper is at least 10 years old.

The landlord should not be put into a position whereby they would be better off and so given that I consider that this wallpaper is at the end of, or even beyond its expected life, the claim that the tenant pay for the insurance excess is dismissed. Filing fee reimbursement

The landlord has not been successful with their claim against the tenant and so their application for reimbursement of the filing fee is also dismissed. C ter Haar 02 April 2026
