Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- I find that the tenant did not leave the carpets reasonably clean and tidy. I accept the tenant’s evidence that the sofa was returned in an acceptable condition based on earlier discussions with the landlord.
- The amounts ordered are for carpet cleaning costs to a reasonably clean and tidy standard only.
- The bond has since been refunded to the landlord towards part of the rent arrears.
- Only the amounts ordered are proved.
