- This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to her and nor did she ring in to the hearing. The hearing proceeded in her absence.
- The landlord has applied for compensation following the end of the tenancy on 28 October 2025.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The photographs show that the tenant left the premises in a very dirty condition.
- I accept the cost of cleaning which includes cleaning and carpet cleaning. It does not include the kitchen oven for which the landlord has not claimed.
- The amount ordered is proved.
Is the tenant responsible for the damage to the premises?
- A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
- The photographs taken at the end of the tenancy show that the laundry cabinet door and the hot water cupboard door were off their hinges and needed to be rehung.
- The photographs also show a very significant stain on the carpet in bedroom 2 resulting in the carpet requiring patching.
- A significant hole in the bathroom door was also shown in photographs.
- These damages were well beyond fair wear and tear.
- The amounts ordered to remedy these issues are proved.
- I note that at today’s hearing the landlord withdrew a claim for a patch in the carpet in bedroom 3 and a claim about a kitchen drawer not closing. C ter Haar 07 April 2026
