- Gurmeet Singh, Harpal Singh, Kabal Singh and Onkar Singh must pay the debt in full by 5pm on Tuesday 17 March 2026. This payment is in addition to normal weekly rent of $850.00. The next payment of normal weekly rent is due on Monday 16 March 2026.
- Payments will be allocated in the following order: normal weekly rent, rent arrears, water rates, and the filing fee.
- If the tenants fail to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 29 Watson Place, Papatoetoe, Auckland 2025 will terminate immediately with possession of the premises returning to the landlord; and b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the water rates and/or the filing fee within 2 working days of the due date the amounts outstanding will be payable immediately.
Reasons
- Mr Singh attended the hearing for the landlord. The tenants were phoned on the numbers provided but there was no response to the calls to the numbers ending in 004 and 862 and the call to the number ending in 717 went to voicemail. Mr Onkar Singh answered the number provided for him, but he said that he did not want to participate in the hearing. He said that he vacated the premises some time ago.
- The tenants were more than 21 days in arrears with rent on the date of the application and are more than 21 days in arrears as at the date of the hearing. This means that the landlord is entitled to an order terminating the tenancy: s 55(1) of the Residential Tenancies Act 1986. However, Mr Singh said that he is prepared to give the opportunity to pay off the rent arrears to avoid immediate termination.
- The conditional termination order will lapse if it is fully complied with. If the tenants breach the order, the possession order may be enforced for 90 days from the first breach: section 64(4)(b) Residential Tenancies Act 1986.
- The amount of rent and the amount of water rates owing has been established by the production of a rent record and water invoices.
- The landlord has been successful in its claims and is therefore entitled to payment of the Tribunal application fee.
