Order
- Lodge City Rentals Limited as agent for David & Robyn Wells is granted possession of the premises at 22 Cosmith Lane, Dinsdale, Hamilton 3204
- 59pm,Monday 2 February 2026.
- Samuel Charles Whitehead to pay Lodge City Rentals Limited as agent for David & Robyn Wells $28.00 calculated as shown in table below.
Reasons
- The landlord attended the hearing. The tenant did not appear and the hearing continued in their absence.
- The landlord has applied for possession of the premises following the termination of the tenancy.
- The tenancy ended on 3 January 2026 after the landlord issued the tenant a 90 day notice terminating the tenancy on this date. The reason for the termination was the owner needed to sell the premises. The notice was valid and I find that they are entitled to possession.
- On 22 December 2025, the landlord extended the termination date to 19 January 2026. The tenant remained in the premises after this date.
- At the hearing, the landlord provided a copy of an email from the tenant confirming that they will vacate the premises on 2 February 2026.
- The termination date of the tenancy, being 19 January 2026, is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied.
- Because Lodge City Rentals Limited As Agent For David & Robyn Wells has substantially succeeded with the claim I have reimbursed the filing fee.
