- This is a fixed term tenancy that started on 15 October 2025 and is not due to end until 14 October 2026.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- The tenant does not dispute the amount of the arrears but says that he has claims against the landlord for multiple issues regarding maintenance and repairs. He also alleges harassment by the landlord. However, he has not filed a cross application nor put together a list of issues/complaints for the landlord to consider and address.
- Mr Reeve, who appeared for the landlord advises that he is open to discussing and resolving any issues the tenant wishes to raise.
- As discussed at the hearing, I would encourage the tenant to compile a complete list of issues and to email those to Mr Reeve as soon as possible. He could also serve a 14-day notice on the landlord setting out the issues and what the landlord needs to do to fix them.
- The tenant may also lodge a claim with the Tribunal for work orders and/other available remedies.
- In the meantime, even though the tenant may have claims against the landlord, he must pay rent. Rent is payable unless a rent reduction/ compensation is agreed with the landlord or the Tribunal makes orders for monetary awards that will offset the arrears, should the tenant apply to the Tribunal.
