Order
- The tenant must pay the debt at the rate of $150.00 per week.
- The first payment must be made on Wednesday 21 January 2026 and payments must continue every Wednesday until the debt is paid in full.
- If the tenant fails to make any payment within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.
- The landlord’s application for termination is dismissed.
Reasons
- Both parties attended the hearing. The landlord attended by video and the tenant attended by telephone.
- The landlord has applied termination of the tenancy, for rent arrears and reimbursement of the filing fee.
- The application for termination was made in reliance of section 56 of the Residential Tenancies Act 1986. The landlord served 14-day notices on the tenant for non-payment of rent.
- The tenant has been in credit for rent for most of the tenancy. In November 2025 she missed three weeks of payments but fully cleared those arrears soon afterward. She says that at the time she was stuck overseas due to a passport issue.
- At the date of hearing the tenant is less than two weeks in arrears and is willing to make regular weekly payments of $150.00 to clear those arrears.
- While the landlord had served the tenant with two fourteen-day notices in December 2025 the tenant was at the time no more than 7 days in arrears.
- The Act requires 1 that the breach is of such a nature or of such an extent that it would be inequitable to refuse to make an order terminating the tenancy. I am not satisfied that it would be inequitable to refuse to terminate the tenancy in the circumstances. The landlord’s claim for termination is dismissed.
- Because Barfoot & Thompson Property Limited As Agents For Sandra And Alan Flood has substantially succeeded with the claim I have reimbursed the filing fee.
