Reasons
- A representative of the landlord attended the hearing.
- The tenant did not join the hearing by either the video link or dial-in instructions provided in the Notice of Hearing.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations and rent arrears.
Should the tenancy be terminated?
- The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
- Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
- The tenant has breached their obligations by failing to pay rent when it is due.
- The landlord served a 14-day notice on the tenant on 24 December 2025, and the tenant did not remedy the breach within the required period. However, the tenant has made the regular weekly rent payments every week from 5 January 2026.
- It would be inequitable to terminate the tenancy because the rent is being paid each week. The arrears arose during a two-week period at the start of the tenancy. The tenant must pay that rent, but the breach is not so significant to justify ending the tenancy.
- The application for termination is dismissed.
- The landlord has also applied for rent arrears and has provided rent records which prove the amount owing as at 10 March 2026. I have made an order accordingly.
- As the landlord was partially successful, I have also awarded reimbursement of the Tribunal application fee.
