- The landlord attended the hearing. The tenant did not answer the call I made to his phone.
- The landlord has applied for compensation following the end of the tenancy. The claim for rent arrears was withdrawn at the hearing.
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, return all keys and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
- The landlord has proved the towel rail was missing at the end of the tenancy. The amount ordered is proved.
- Tenants must return the premises in a reasonably clean and tidy state and remove their rubbish at the end of the tenancy. This includes the lawns. The RTA does not require the premises to be provided or returned in a spotless or an immaculate condition. The standard is based on what an average bystander would consider reasonable, not on the subjective opinions of the landlord and tenant.
- There is no scientific way to determine what is reasonably clean and tidy, and the Tribunal must evaluate the evidence available, and in particular inspection reports and photographs.
- This is the landlord’s claim to prove. The landlord provided good photos taken at the end of the tenancy. I can see there was a small amount of rubbish inside the house and the claim is reasonable. I can see the lawns were very long and they had to be slashed before they could be mowed. I have allowed an amount for this work that seems fair to me.
