Sueni Lambert and Monson Ah Chong owes Waikato Real Estate Limited As The Agent For Jacinda Rennie $6,341.13 (“the debt”).
Sueni Lambert and Monson Ah Chong must pay rent and the debt as follows: a. By making one payment of $6,341.13 payments of being $6,313.13 for rent arrears and $28.00 for the filing fee, by 8pm on Tuesday 3 March 2026.
Payments will be allocated in the following order: rent arrears, and the filing fee.
If the payment of $6,341.13 is made as per Order 2 above, then the tenancy terminates at midnight on Wednesday 11 March 2026.
If the tenants fail to pay the rent arrears as per Order 2 above: a. The tenancy at 5A Paul Crescent, Fairfield, Hamilton 3214 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenants fail to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing – the landlord by video and the tenant by telephone. Ms Lambert advised that she was representing both tenants at today’s hearing.
The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment of the bond. The tenant wants to repay the debt to avoid immediate termination.
Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
At today’s hearing the landlord advised that it was her instructions from the owner that the tenancy was to be terminated. In order to avoid immediate termination however, the parties came to an agreement as reflected in the above Order.
The tenant has agreed to pay the debt in full by 8pm this evening and in return the tenants would be granted a week’s extension of the termination.
After discussion with the tenant I am satisfied the tenants will pay the debt within the period specified in the order and I have allowed the Order by Consent.
If the tenants breach the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. C ter Haar 03 March 2026
