- The landlord attended the hearing held on 13 April 2026 by video. The tenant did not attend the hearing. An attempt was made to join the tenant to the hearing by telephone, but the call went to voicemail.
- The landlord has applied for compensation and refund of the bond following the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
- The landlord had claimed for rubbish which included several large logs and firewood. It may be that a tree was felled on the section, so I am not sure that this is rubbish for the tenant to remove. That part of the claim is not awarded.
- The landlord applied for damage to the premises including wall holes and damaged doors. There were no pre tenancy photographs showing that this damage was not present at the beginning of the tenancy. For this reason, the landlord withdrew the claims for damage.
