Order
- An application for suppression has been made by the tenant. The grounds for suppression are not established. 1
- Mireama Houra owes Austar Property Services Limited t/a Ray White as Agent for Suellen Fraser as Trustee for The APSL Family Trust $5,276.72 (“the debt”), as follows:
- Mireama Houra must pay rent and the debt as follows: a. By weekly payments of $850.00 (or any amount to which the weekly rent is changed), for weekly rent, on Wednesday 4 March 2026 and each Wednesday after that; and 1 See s95A RTA b. by a payment of $5,276.72 to pay the debt in full, no later than Tuesday 24 March 2026.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay: a. the weekly rent when it is due in terms of Order 3a at any time within 3 months from the date of this Order; or to pay b. the sum of $5,276.72 to repay the debt in terms of Order 3b; then c. the tenancy at 6 Tauwaka Crescent, Riverhead, Riverhead 0820 will terminate and the landlord will have immediate possession of the premises; and d. the balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- Having heard from the tenant and about her ability to repay the arrears, and having regard to the length of the tenancy, I am satisfied she should be given the opportunity to clear the debt and demonstrate that she is able to pay the rent when due. That would be in the landlord’s interests as well, provided the landlord is protected against the debt increasing in the meantime.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- Because Austar Property Services Limited t/a Ray White as Agent for Suellen Fraser as Trustee for The APSL Family Trust has succeeded with the claim I must reimburse the filing fee.
