Order
- The tenancy of Elisapeta Gisa at 939A Cameron Road, Gate Pa, Tauranga 3112 is terminated, and possession is granted to Accessible Properties Limited, immediately.
- Elisapeta Gisa must pay Accessible Properties Limited $4,739.86 immediately, calculated as shown in the table below:
- The Bond Centre is to pay the bond of $218.00 (5502364-004) to Accessible Properties Limited immediately.
Reasons
- Ms Quinn Fitzpatrick, representing the landlord, and Ms Gisa, the tenant, along with two support people, Mr Tuaau and Ms Moli, all attended the hearing by teleconference and video conference respectively.
- The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.
Should the tenancy be terminated?
- I am not satisfied that the tenant is unlikely to commit any further rent breaches or that the rent arrears owing will be paid within a specified time, given the evidence provided, particularly the history of rent payments indicated on the rent summary and evidence from the tenant about her lack of income until last week when she obtained seasonal work. As such, I decline to make a conditional termination order. See section 55(1A) Residential Tenancies Act 1986.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
How much rent is owing?
- The landlord provided rent records which prove the amount owing to 25 March 2026, which is the end of the tenancy, which is $4,929.86. Refund of the bond
- The Bond Centre is to pay the bond of $218.00 (5502364-004) to Accessible Properties Limited immediately. Filing fee
- Because Accessible Properties Limited has been successful with the claim I must reimburse the filing fee.
