- Tokoa Ngaau owes Te Ahuru Mowai Limited Partnership $3,594.72 (“the debt”), calculated as in the order below.
- Tokoa Ngaau must pay rent and the debt as follows: a. By 71 weekly payments of current weekly rent plus $50.00 for the debt. b. A final payment of current weekly rent plus $44.72 for the debt. c. Payments will be every Monday, with the first payment on 25/05/2026 and continuing until 04/10/2027.
- Current weekly rent is $90.00 so the weekly payment due at the date of this order is $140.00. If current weekly rent changes, then the weekly amount payable will also change to always be weekly rent plus $50.00.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 82 Te Pene Avenue, Titahi Bay, Porirua 5022 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing remotely today.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
- The landlord supplied rent records which prove the amount owing. I award $3,566.72 for rent arrears calculated up to 26 May 2026. I also award the filing fee.
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- After discussion in the hearing, I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- If the tenant breaches the order, the possession order may be enforced (by applying for a warrant of eviction) for 90 days from the first breach. Section 64(4)(b) Residential Tenancies Act 1986.
- I make no suppression orders. The landlord has succeeded with its application but there is a public interest in its actions as a social housing provider responsible for the use of taxpayer funds. There is no good reason to suppress the tenant’s name.
