Should the tenancy be terminated?
- The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
- Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
- The tenant has breached their obligations by failing to pay rent when it was due.
- The landlord served a 14-day notice on the tenant on 31 December 2025 and the tenant did not remedy the breach within the required period.
- It would be inequitable to refuse to terminate the tenancy because the Tenant is still currently in rent arrears and has been consistently in rent arrears for the past few months
How much is owed for rent arrears?
- The landlord provided rent records which prove the amount owing as at the date of the hearing.
- The Tenant did not agree with the rent records and submitted there should have been no rent arrears because she moved in one week after the tenancy started and at mediation in February 2026, the Landlord stated there were no further rent arrears. The Tenant felt victimised by the Landlord.
- The Tenant did not submit any evidence such as a rent summary or rent receipts to show she paid rent on the weeks the rent summary showed she paid nothing. She also did not have any written agreement from the landlord stating there were no rent arrears in February 2026. Had the Landlord agreed to waive all the rent arrears as the Tenant asserts, they would not have proceeded with the hearing.
- The Landlord submitted the rent records were correct. They clearly show she when the Tenant accrued rent arrears such as on the 13 March 2026, when nothing was paid,
- In considering the evidence, I find the Tenant has accrued the rent arrears claimed which is explained in the rent summary provided.
- The amount ordered is proved.
- As Barfoot & Thompson Limited As Agents For Jingji Ge has wholly succeeded with the claim the Tenant must reimburse the filing fee.
