Reasons
- This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to her and nor did she ring in to the hearing as directed in her Notice of Hearing. Further, both calls I made to the number provided for her went to voicemail. The hearing therefore proceeded in her absence.
- The landlord advised at today’s hearing that they sought a time payment order to formalise the regular $50.00 weekly payment that the tenant was paying towards the rent arrears and compensation claims.
- I am unable to make such an order in the absence of the tenant because it is essentially an agreement between the parties and she was not here to agree to it.
- I am therefore ordering her to pay the outstanding amounts immediately, but with the recognition that the landlord will not enforce the order if the tenant continues to make the $50.00 weekly payments.
- The amount of rent owing as at today’s date is proved by the rent record.
- At today’s hearing the landlord withdrew the claim against the tenant for curtains, and so the only compensation they are seeking is the cost of the skip bin, the cost of the replacement door, and the cost of a change of locks. Given the amount that the tenant has already paid, the amount outstanding for this part of the claim is now $313.00. C ter Haar 06 May 2026
