Reasons
- The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
- This was a continuation hearing after an adjournment on 8 April 2026. That adjourning order also varied the landlord application and served as notice of that to the tenant.
- The tenant did not appear at the previous hearing. There has been no contact since. She has not been communicating with the landlord.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. A second ground for termination, being denial of landlord access was cited but not relied upon here for the termination order.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy is as ordered.
- Because Christchurch Methodist Central Mission has wholly succeeded with the claim I must reimburse the filing fee.
