- I have reviewed the photographic evidence and am satisfied that the costs for lawn mowing and rubbish removal were reasonably incurred as a result of the tenant’s breach of section 40(1)(e)(iii) of the Residential Tenancies Act, namely the obligation to leave the premises in a reasonably clean and tidy condition and to remove all rubbish.
- I am further satisfied that the cost of $82.08 for patching the two holes was reasonably incurred as a result of the tenant’s breach of section 40(2)(a), namely the obligation not to intentionally or carelessly damage the premises. That amount is therefore also awarded.
