- Meri Dot Moeroa Stevens and Norman Ataria must pay rent and the debt as follows: a. By 31 weekly payments of $700.00, being $650.00 for rent and $50.00 for the debt. b. A final payment of $678.00, being $650.00 for rent and $28.00 for the debt. c. Payments will be every Thursday, with the first payment on 23/04/2026 and continuing until 26/11/2026.

Should the tenancy be terminated?
- The landlord filed their application on 25 January 2026. Rent arrears were $2,442.85 (26 days) on this date. Because rent was more than 21 days in arrears on the date the application was filed, I must make either a final or conditional termination order. 1
- I choose to make a conditional termination order, because I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. 2 My reasons for this are as follows: a. Rent arrears have reduced from $2,442.85 to $1,550.00. This shows the tenant is making a concerted effort to pay their rent when due and clear the arrears. b. The tenant has consistently paid $700.00 per week on time from 10 February 2026.
- The landlord does not oppose the Tribunal making a conditional termination order and in fact requested if this could be done. 1 Residential Tenancies Act 1986, section 55(1)(a) and (1A). 2 Residential Tenancies Act 1986, section(1A).
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. 3
