Reasons
- The landlords attended the hearing. Mr Kehely who is named as the landlord appeared and is joined as a party to the proceedings. He gave his consent for Ms Jensen to speak on their behalf.
- Mr King attended, but Mr Aramoana did not appear. Mr Aramoana had been removed from the tenancy by a variation dated 27 February 2026.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- The tenancy agreement was varied by agreement on 27 February 2026, at which point Mr Aramoana was removed as a tenant. From that date, he ceased to have rights of occupation and ceased to be a party liable for rent under the tenancy.
- Rent is payable only by tenants, and although he continued to pay some rent after he left, and there is no evidence that Mr Aramoana agreed to remain liable for rent after the was removed from the tenancy.
- Accordingly, this order records that Mr Aramoana is liable only for rent arrears accrued up to and including 27 February 2026, being $2278.57.
- From this date Mr King became the sole tenant is responsible for the payment of the rent.
- The landlord provided rent records which prove the amount owing at the end of the tenancy which is more than 21 days in arrears. The Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- The tenancy is terminated.
- Because Michaela Marie Jensen and David Kehely have wholly succeeded with the claim I must reimburse the filing fee.
