- The landlord attended the hearing. There was no appearance for the tenant.
- The parties entered into a fixed-term tenancy agreement from 16 January 2026 to 16 January 2027. The tenant is liable for rent for the entire period.
- The tenant decided she did not want to continue the tenancy and returned the keys. She did not agree to pay a break-lease fee.
- The property management company managed to secure a tenant from 12 February and so seeks rent arrears up to 11 February 2026. They have provided rent records which prove the amount owing.
- Because the tenant reneged on her responsibilities, the landlord had to readvertise the property, vet new applications and undertake further inspections. The advertising cost $330.
- The landlord submitted an invoice for $800 including GST. It was not itemised. I have ordered $500 as a reasonable cost for finding new tenants. The landlord should be compensated for loss brought about by the tenant’s actions.
- Because All Property Management Nz Limited As The Agent For Vay Family Trust has wholly succeeded with the claim I must reimburse the filing fee.
