The landlord attended the hearing by video. The tenants were sent the notice of hearing with instructions for joining the hearing by video or telephone. However, they did not attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 18 February 2026 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. Prior to this date the landlord received information about activity at the premises and that the tenants may have left. An inspection on 18 February 2026 established that most of their belongings and furniture had been removed from the premises. There was also extensive damage with holes in walls and ceilings and removal of gib. Photos from the inspection were produced in evidence.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.
