Reasons
- The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
- The landlord has applied for rent arrears, water rates, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- Unfortunately, the tenants had a change in family circumstances during the tenancy. This was advised to the landlord on 11 December 2026 and communication was exchanged regarding ongoing liabilities. The tenants preferred for the landlord to seek a new tenancy on their behalf. A break lease agreement was signed on 17 December 2025 but the landlord advised it was unable to gain access for potential tenant viewing while the tenants remained in the premises.
- On 15 January 2026 the tenants informed the landlord they would be moving out on 17 January 2026.
- The landlord was actively advertising the premises and confirmed the following activity attempting to source a new tenancy: We organised 8 viewing schedules on 19, 22, 26, and 31 January 2026; 14 and 19 February 2026; and 7 March 2026. One additional viewing scheduled for 24 January 2026 was cancelled as the only prospective viewer could not be contacted. A total of 14 applications were received through RENTI. Of these, 1 applicant was approved and commenced tenancy on 27 March 2026, 1 applicant decided on another property, 2 were no longer interested, and the remaining applicants did not attend scheduled viewings despite being invited.
- I am satisfied the landlord took reasonable steps to mitigate the increasing rent arrears. The extended rent liability is regrettable but it does not appear to be due to any failure of the landlord.
How much is owed for rent and water rates?
- The tenancy rent liability ended on 26 March 2026. The tenants had left the fixed-term tenancy earlier. It would have ended on 27 March 2026 but a new tenancy commenced a day earlier, reducing rent liability by that one day.
- The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy for rent and water are as ordered. Filing fee
