Should a conditional termination order be made?
- Rent was 21 days in arrears when the application was filed. Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order by virtue of s 55(1)(a) and (1A) of Residential Tenancies Act 1986.
- The landlord filed a rent summary which proves the arrears are as set out in the table above. The tenant has been paying rent on Mondays. No rent was paid this Monday, however. I order the tenant pay rent due to the end of this Sunday to regularise the rent but add that amount to the debt, so it is not payable immediately.
- The landlord is content to seek only a conditional order. The Tribunal makes that order by consent
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the landlord may enforce the possession order for 90 days from the first breach pursuant to s 64(4)(b) Residential Tenancies Act 1986 and the debt shall be enforceable immediately.
